General terms and conditions
The present general terms and conditions – hereinafter referred to as “Terms and Conditions” – regulate the conditions of use of services on www.birdflow.org website – hereinafter referred to as “Service” – provided by Bíró Bálint individual entrepreneurs – hereinafter referred to as “Service Provider”.
1. The Provider of Service

2. Description of Service
The service provider share articles, studies and other content related to parrot education with the users of service (hereinafter referred to as “Users”) through www.birdflow.org website (hereinafter referred to as “Website”)
The purpose of the service is to introduce the latest trends of marketing copywriting with the Users, and practically useful knowledge regarding the subject.
3. Object of the contract
Based on this contract, the User entrusts the Service Provider to provide education material related to parrot keeping within the framework of the Service. One of the object of the contract includes materials which are available at the time of conclusion of the contract, as well as materials prepared by the Service Provider and published on the website. The exclusive Service Provider is Bíró Bálint individual entrepreneur, who explicitly accepts the assignment.
In addition to the above-mentioned Service, the Service provider occasionally posts personal information on the website, which are related to parrot keeping services and products (personal training, consultation opportunities, consultancy and coaching, parrot foods, parrot toys), transferring printed or electronic reproductions of publications (hereinafter referred to as “Other services”). The contract related to these deals is created between the Contracting Parties by pressing the “Order” button, with the content and price of data sheet of Other services.
4. Conclusion of Contract
This contract is created implicitly between the Service Provider and User – hereinafter together: “Contracting Parties” – by the User on www.birdflow.org website, or on its sub-page registration form, by pressing the “Order” button.
The User declares with the acceptance of this contract, that his legal capacity or ability to contract is not limited.
During application, data provided by the visitor must be complete and real. The visitor declares that such given data are complete and valid.
With the acceptance of the present Contract, the User expressly consent to the Service to begin the contractual performance immediately after the conclusion of contract.
5. Confirmation of application
The Service Provider will immediately examine the registrations as he received them, and he also confirms their arrival. The Service Provider reserves the right to reject the received registrations without justification. The accepted registrations will be confirmed by e-mail.
6. The rate of the participation fee and the free trial period
The Service Provider is authorized for a monthly price + VAT fee for providing services, which means gross total of price accepted in the order form, when the User is eligible for the benefits per the detailed conditions of the website, and especially for the one-time free trial period.
7. Fulfilment of the contract fee
During registration, the candidate must provide his bank card information. The candidate declares, that the specified bank card data are real, and he disposes the specified bank card legally.
The Contracting Parties declares that Braintree payment system related to the Service is operated by PayPal (Europe) S.à r.l. et Cie, S.C.A., (R.C.S. Luxembourg B 118 349), which is considered as fulfilment assistant of Contracting Parties during the fulfilment of the contract.
The general terms and conditions and privacy statement of Braintree can be read continually on https://www.braintreepayments.com/legal website, which the Contracting Parties have learned and adopted.
When any free trial period is completed, the Service Provider can draw the commission fee in advance from the User’s bank card through the payment service provider.
Within 15 days after deduction of commission fee, the Service Provider must issue electronic invoices, which will be transmitted electronically to the user. The User expressly accepts the issue of electronic invoice.
9. Initiate termination
The User can initiate the termination of contract providing Services through the website, or he can send his legal statement of termination to the email@example.com e-mail address. The sample of the declaration of termination is included in Annex 1 of this contract.
10. Termination during the free trial period
The User who is not considered as a consumer, during the free trial period, he can terminate the contract with immediate effect.
11. Consumers are entitled to the termination and withdrawal right
The User qualified as consumer can terminate the contract providing Service within 14 days after the conclusion of the contract. After the expiration of free trial period, the Service Provider will be eligible for the prorated portion of commission fee, and he will repay the excess of this fee to the bank card of the User.
The User qualified as consumer may withdraw from contract about transferring the ownership of movable property within 14 calendar days of receiving the product.
12. Ordinary termination
Any of the Contracting Parties – in accordance with the provisions of points 9 and 10 of this contract – can terminate the contract after 14 calendar days after its conclusion, because the last day of termination is the same as the thirtieth day after the deduction of commission fee.
13. Extraordinary Termination
The Contracting Parties can only terminate the present contract with immediate effect by filing an affidavit to the other parties, if the other parties violate repeatedly or seriously their essential obligations arising from the present contract.
14. Exclusion of compensatory liability
The Service Provider excludes the compensatory liability related to the caused damage with fullest extent by applicable law.
The Contracting Parties agree that the www.birdflow.org website, its elements and all materials published or sold through it, form the property of the Service Provider. No part of this contract should be interpreted that in this way the User obtains any usage or other property right through the materials.
16. Merger clause
The present contract contains the entire agreement between the Contracting Parties with respect to regulated legal relationship, and it invalidates any prior oral or written agreement.
17. The scope of the contract
The agreement was created for an indefinite period.
18. Law and final provisions applicable to the contract
The Contracting Parties regard the Civil Code or other relevant provisions of the current Hungarian law as the basis, if they have issues which are not settled in the contract.
The Contracting Parties agree that the place of execution of contracts is Hungary.
19. Complaint Handling
The User can send his complaints about the Service to the e-mail address of the Service Provider: firstname.lastname@example.org
